No. It’s not resolved. The referenced patch actually breaks ACL support on FreeBSD. Maintainer hasn’t fixed it.

FYI:

Due to expectations of having a rsync of the same characteristic when communicating intersystems, this update may fix some rsync issues

The Debian stable release & Cygwin release has both at 3.2.3 version
